CHOW Terms of Service

Version 1.0 · Last Updated: August 1, 2026

Business Draft — Requires Final Legal Review

1. Acceptance of Terms

By creating an account, placing an order, or using the CHOW platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. CHOW provides an online marketplace connecting customers, merchants, and couriers for food, grocery, pharmacy, wellness, and on-demand delivery services in Port St. Lucie, Florida and surrounding areas.

2. User Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 18 years old to use the Service. CHOW reserves the right to suspend or terminate accounts that violate these Terms.

3. Ordering and Payments

When you place an order, you authorize CHOW to charge the payment method you select for the total amount shown, including subtotal, delivery fee, applicable taxes, and any optional tip. Orders are subject to merchant availability and acceptance. Prices are set by merchants and confirmed at checkout. CHOW uses Stripe to securely process card and digital payments. Cash on delivery is available for select orders and is collected by the courier upon delivery.

4. Delivery and Fulfillment

CHOW facilitates delivery through independent couriers. Estimated delivery times are approximate and not guaranteed. CHOW is not liable for delays caused by merchants, couriers, weather, traffic, or other factors outside its control. You agree to be available at the delivery address and to provide accurate delivery instructions.

5. Merchant and Courier Relationships

Merchants and couriers are independent contractors, not employees or agents of CHOW. CHOW provides a technology platform and is not responsible for the quality, safety, or legality of items sold by merchants. Any disputes regarding food quality, preparation, or merchant service should be directed to the merchant. CHOW facilitates resolution but is not a party to merchant-customer transactions.

6. Cancellations and Refunds

Order cancellation and refund rights are described in detail in the CHOW Refund and Cancellation Policy. Generally, orders may be canceled before merchant acceptance. After acceptance, cancellation eligibility depends on the stage of fulfillment. Refunds for card payments are processed back to the original payment method and may take 5-10 business days to appear.

7. Prohibited Conduct

You agree not to misuse the Service, including: placing fraudulent orders, providing false information, harassing merchants or couriers, attempting to circumvent payment systems, reverse-engineering the platform, or using the Service for any illegal purpose. Violations may result in account termination and legal action.

8. Limitation of Liability

CHOW provides the Service "as is" without warranties of any kind. To the maximum extent permitted by law, CHOW shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill. CHOW's total liability for any claim shall not exceed the amount you paid to CHOW for the order giving rise to the claim.

9. Changes to Terms

CHOW may update these Terms from time to time. Material changes will be communicated through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms. The version number and date indicate the current version.

10. Governing Law

These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the courts located in St. Lucie County, Florida, unless otherwise required by law.
